Govt replaces ‘mental illness’ with ‘unsound mind’ in 3 criminal law bills

On the suggestion of a parliamentary panel, the federal government has substituted the phrase “unsound mind” for “mental illness” within the redrafted felony code laws that search to switch the British-era Indian Penal Code, CrPC, and Indian Proof Act.

The Bharatiya Nyaya Sanhita Invoice, along with the Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam payments, was tabled within the Lok Sabha for the primary time on August 11.

The proposed laws utilised the phrase ‘mental illness’ with which means granted to it in clause (a) of part 2 of the Psychological Healthcare Act, 2017.

The Parliamentary Standing Committee on House Affairs, headed by BJP MP Brijlal, had beneficial that the phrase “mental illness” within the proposed legal guidelines could also be modified to “unsound mind” as psychological sickness is just too extensive in its import compared to unsound thoughts, because it seems to incorporate even temper swings or voluntary intoxication inside its ambit.
